REALTORS® need to know about Competition Law

  1. Other REALTORS® are competitors – cooperation has limits
  2. Competition law affects marketing, social media, and advertising
Boards & Associations need to know about Competition Law:
  1. What can and cannot be discussed in meetings
  2. How industry dominance can be misused
  • Discussing rebates and discounts with another REALTOR® when negotiating a specific transaction is part of closing the deal.
  • Discussing commission rates, discounts, or rebates with other REALTORS® in your area to "set the going rate" violates Section 45 of the Competition Act. It is a criminal offence for two or more competitors to set prices for providing services.

Making a sales performance claim – Number 1 REALTOR® – may violate the Competition Act. Advertising claims must be based on "an adequate and proper test." According to Article 15 of the REALTOR® Code, you must include the time frame, source, and geographical area to back up any claim. Including these facts in your ad will help you pass the test.
